This is not right – Speaker Bagbin on Gyakye Quayson’s daily trial order  

The rule must apply to everyone equally

The speaker of Parliament, Alban Sumana Kingsford Bagbin, has voiced his opinion over the High Court’s decision to hear James Gyakye Quayson’s case on a daily basis.

He claims that the court is biased because other MPs who have the same issue as Gyakye Quayson are not being treated in the same fashion. Additionally, he noted that this court is applying rule by law instead of rule of law.

Speaker Bagbin made this assertion during a meeting with the Graphic Communications Group Limited, which 1Family Radio monitored.

“I believe that we should move away from what we are doing, which is rule by law rather than rule of law. The rule of law must be a cornerstone for democracy to prosper.’’

”I tell the lawmakers as well as the judges that it is wrong. I don’t have an issue if it’s applied to everyone, but if it’s done selectively, I do,” he remarked.

“The law is not the center of democracy; that is one of the mistakes in our 1992 constitution. Read through our constitution, and you’ll see the law is a respecter of so many people.’’

“In Ghana, a huge number of people disregard the law. You cannot have democracy with that, so we must work diligently to address it. For this reason, we must undertake a constitutional review,” he added.
